The Terms of Service set forth the terms and conditions governing your use of the services, facilities, website, and mobile applications of Third Eye Yoga, LLC (“Third Eye Yoga”). By accessing or using Third Eye Yoga’s services, you acknowledge and agree to these Terms.
• Acceptance of Terms
By accessing or using the services, website, or mobile applications of Third Eye Yoga, including booking classes through Mariana Tek, you agree to be bound by these Terms of Service and the respective Terms of Service of Third Eye Yoga’s third-party software.
• Services Provided
Third Eye Yoga offers yoga and wellness classes, including but not limited to vinyasa, restorative yoga, prenatal yoga, and teen classes, provided in-studio and through related online platforms.
• Eligibility and Minors
Third Eye Yoga’s services are not directed to children under the age of 13. Individuals ages 13 through 17 may participate only with the written consent of a parent or legal guardian, who agrees to these Terms on their behalf.
• Health and Safety
Participation in Third Eye Yoga’s yoga, wellness, and related activities involves inherent physical risks. By participating, you represent that you are in appropriate physical condition and understand that it is your responsibility to consult a physician as needed. You agree to follow all instructions provided by Third Eye Yoga staff and to notify instructors of any injuries, limitations or medical conditions.
• Assumption of Risk and Waiver of Liability
To the fullest extent permitted by law, you voluntarily assume all risks associated with participation in Third Eye Yoga’s services and release and hold harmless Third Eye Yoga, its owners, employees, and contractors from any claims for injury, loss, or damage arising out of or related to your participation, except to the extent caused by gross negligence or willful misconduct.
• Scheduling, Classes, and Pricing
All classes, scheduling, instructors, pricing, and membership options are subject to change at the discretion of Third Eye Yoga as its studio evolves. Booking and account management are conducted through Third Eye Yoga’s designated third-party platform, Mariana Tek.
• Booking, Payments, and Confirmation
All classes and services must be booked through Third Eye Yoga’s designated platform, including Mariana Tek. Payment is due at the time of booking unless otherwise specified. Cancellation and no-show policies, including any applicable fees, will be set forth at the time of booking and are incorporated herein by reference.
Third Eye Yoga utilizes third-party platforms, including Mariana Tek and Twilio, for scheduling, communication, and payment processing. Third Eye Yoga is not responsible for the independent practices or terms of such third parties.
All purchases, including memberships and retail items in the boutique, are final and non- refundable, and may not be transferred to another individual. Gift cards are not redeemable for cash. The use of false identification or misrepresentation to obtain discounted rates or promotions is prohibited.
• Studio Conduct and Policies
Third Eye Yoga maintains policies to ensure a safe and respectful environment. Use of cellular phones within the studio space is not permitted. Studio doors will be locked promptly at the start of each class, and late entry will not be allowed. Students are expected to conduct themselves appropriately while on the premises, and any theft, damage to property, or disruptive or harmful behavior may result in removal from Third Eye Yoga and termination of services.
• Photography and Media
Third Eye Yoga may photograph or record classes and events for marketing and promotional purposes, including social media. By participating, you acknowledge and consent to such use unless you notify Third Eye Yoga in advance that you wish to opt out.
• Intellectual Property
All content provided by Third Eye Yoga, including class formats, materials, logo, branding, and website content, is the property of Third Eye Yoga and may not be used, reproduced, or distributed without prior written consent of a duly authorized representative of Third Eye Yoga.
• Events and Third-Party Services
Third Eye Yoga may offer events, including social or community gatherings, which may be hosted by or in conjunction with third parties. Third Eye Yoga is not responsible for the conduct, services, or offerings of such third parties.
• Alcohol Services
Certain events may include the service of alcoholic beverages in compliance with applicable law. Participants must present valid identification and must not be visibly intoxicated. Third Eye Yoga reserves the right to refuse service in its discretion.
• Disclaimer of Warranties
Third Eye Yoga’s services are provided “as is” without warranties of any kind, express or implied, to the fullest extent permitted by law.
• Limitation of Liability
To the fullest extent permitted by law, Third Eye Yoga shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the use of its services.
• Changes to Terms and Conditions
Third Eye Yoga may, but is not obligated to impose cancellation, no-show, or late fees in the future as class demand and capacity change, and reserves the right to modify or update these Terms of Service from time to time. Continued use of Third Eye Yoga’s services constitutes acceptance of any revised Terms.
• Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of New Hampshire
